Welcome to Gachi App ("App", "Service", "we", "us", or "our"). By accessing or using our Service, you agree to be bound by these Terms of Service ("Terms"). Please read them carefully.

1. Acceptance of Terms

By creating an account or using our Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.

2. Account Registration

2.1 Account Creation

• You must provide accurate and complete information when creating an account
• You are responsible for maintaining the security of your account credentials
• You must not share your account with others
• You are responsible for all activities under your account

2.2 Account Termination

We may suspend or terminate your account if you:

• Violate these Terms or our Community Guidelines
• Engage in fraudulent or illegal activities
• Harass other users
• Create multiple accounts to evade restrictions

3. Time-Limited Content

• Posts are automatically deleted from our servers after expiration
• Expired content cannot be recovered
• You understand and accept this automatic deletion feature
• We are not responsible for any loss resulting from content expiration

4. User Content

4.1 Your Rights

You retain ownership of the content you create. By posting content, you grant us a non-exclusive, royalty-free, worldwide license to use, display, and distribute your content within the Service until it expires or is deleted.

4.2 Content Guidelines

You agree not to post content that:

• Is illegal, harmful, threatening, abusive, or harassing
• Contains hate speech or discrimination
• Is sexually explicit or pornographic
• Infringes on intellectual property rights
• Contains malware or harmful code
• Is spam or deceptive
• Violates the privacy of others
• Promotes violence or self-harm

4.3 Content Moderation

We may remove content that violates these guidelines without notice. We use automated systems to detect harmful content, but we do not guarantee complete accuracy.

5. Voting and Interactions

• Votes are anonymous and cannot be changed after submission
• You may not manipulate voting through fake accounts or automated systems
• Vote manipulation may result in account termination

6. Prohibited Conduct

You agree not to:

• Use the Service for any illegal purpose
• Attempt to gain unauthorized access to other accounts or systems
• Interfere with or disrupt the Service
• Use automated tools, bots, or scrapers
• Impersonate others or create misleading accounts
• Collect user information without consent
• Circumvent security measures or restrictions
• Use the Service to send unsolicited communications

7. Intellectual Property

7.1 Our Property

The Service, including its design, features, and content (excluding user content), is owned by us and protected by copyright, trademark, and other intellectual property laws.

7.2 Feedback

Any feedback, suggestions, or ideas you provide about the Service become our property and may be used without compensation or credit to you.

8. Third-Party Services

The Service may integrate with third-party services (Google, Apple, Kakao for login; Google for advertising). Your use of these services is subject to their respective terms and privacy policies.

9. Disclaimers

We do not warrant that:

• The Service will be uninterrupted or error-free
• The Service will meet your specific requirements
• Content will be accurate, complete, or reliable
• Any defects will be corrected

10. Limitation of Liability

Our total liability shall not exceed the greater of: (a) the amount you paid us in the 12 months prior to the claim, or (b) $100 USD.

11. Indemnification

You agree to indemnify and hold harmless Gachi App and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from:

• Your use of the Service
• Your content
• Your violation of these Terms
• Your violation of any third-party rights

12. Governing Law (California)

For users outside the United States, these Terms are governed by the laws of the Republic of Korea.

13. Dispute Resolution

13.1 Informal Resolution

Before filing any legal claim, you agree to first contact us at support@gachi.info to attempt to resolve the dispute informally. We will attempt to resolve the dispute within 60 days.

13.2 Binding Arbitration (US Users)

For users in the United States, any dispute that cannot be resolved informally shall be settled by binding arbitration in accordance with the JAMS Streamlined Arbitration Rules. The arbitration will be conducted in English in San Francisco, California.

13.3 Class Action Waiver

You agree to resolve disputes with us on an individual basis and waive the right to participate in class action lawsuits or class-wide arbitration.

13.4 Exceptions

Either party may seek injunctive relief in court for intellectual property infringement or other urgent matters.

14. Termination

You may terminate your account at any time through the app settings. We may terminate or suspend your access without notice for violations of these Terms.

Upon termination:

• Your right to use the Service immediately ceases
• Your content will be deleted according to our data retention policy
• These Terms continue to apply to any disputes arising before termination

15. Changes to Terms

We may modify these Terms at any time. Material changes will be notified at least 7 days in advance (30 days for significant changes) through in-app notifications or email.

Continued use of the Service after changes take effect constitutes acceptance of the modified Terms.

16. Miscellaneous

• Severability: If any provision is found unenforceable, the remaining provisions remain in effect
• Waiver: Our failure to enforce any right does not waive that right
• Assignment: You may not assign your rights under these Terms. We may assign our rights without restriction
• Entire Agreement: These Terms constitute the entire agreement between you and us regarding the Service
